KYC refers to Know your customer (alternatively know your client or ‘KYC’), the government wants to reconfirm your identity and want you update your KYC.
APPLICABILITY FOR DIR-3 KYC
Following persons are required to file form DIR-3 KYC
- Director of the Company
- Partner/Designated Partner of the LLP
- Qualified & disqualified directors
- Person holding Din prior to 31ST MARCH 2019 even if not appointed as director in any company
- Person holding din as on 31ST MARCH 2019 even if not holding any directorship in any company.
Stakeholders may please note that DIN holders are required to file the DIR-3 KYC form every year so that they are aware of and confirm the data & information as available in the MCA21 system.
REQUIREMENT OF FILING DIR-3 KYC FOR PERSONS HAVING OLD DIN OR BEFORE 31.03.2018
There are lot of People Confused that if they have done kYC Last Year are required to file KYC again or Not. For Clarification, Pls Note that
- Holding DIN Before 31.03.2018 and complied KYC last Year: The Persons who have Done Their KYC last Year/2018 or are having their DIN Active are also required to file their Dir3 KYC without any Govt Fees every year.
- Holding DIN Before 31.03.2018 and not complied KYC last Year: The Directors who are having DIN and who have not complied the KYC Norms last year or having their DIN Deactivated have to file the Dir-3 KYC with a penalty of rs 5000.
PURPOSE OF FILING DIR-3 KYC
The Form Is Introduced To Know The Exact Details (like pan, aadhar, Mobile No email id) Of Every Director Of The Company. Kyc is the process of identifying and verifying the identity of Directors similar to the Bank KYC where Government intends to know the “Active” status of the Director and expects them to submit a yearly intimation.
Only One Form Is Required To Be Filed By Each Applicant Irrespective Of His/Her Directorship
DUE DATE OF FILING DIR-3 KYC
- For all din holders allotted DIN prior TO 31ST MARCH 2019. The Last date is 30th September 2019.
- Fixed penalty Rs. 5,000/- for late filing
- Consequences of Non filing DIR-3 KYC (Director’s KYC) is your DIN will be ‘Deactivated’ with reason as ‘Non-filing of DIR-3 KYC’.
CONSEQUNECES OF NON FILING FEES OF DIR-3 KYC
- As the DIN is allotted once in a lifetime , New DIN Cannot be issued to the person
- There is no filing Fees for Dir-3 KYC Filed Till 30th September, 2019.
- Consequences of Non filing DIR-3 KYC (Director’s KYC) is your DIN will be ‘Deactivated’ with reason as ‘Non-filing of DIR-3 KYC’.
- however if form filed after the due date as mentioned above, there shall be a penalty of Rs. 5000/- per form and in addition thereto, the central government is authorized to deactivate the DIN of director.
- Deactivated DIN can not be used for any incorporation or Appointment until reactivated by paying penalty of rs 5000/-.
TYPES OF FORMS DIR 3KYC
- i) eForm DIR-3 KYC is to be filed by an individual who holds DIN and is filing his KYC details for the first time or by the DIN holder who has already filed his KYC once in eform DIR-3 KYC but wants to update his details.
- ii) Web service DIR-3-KYC-WEB is to be used by the DIN holder who has submitted DIR-3 KYC eform in the previous financial year and no update is required in his details.
DOCUMENTS REQUIRED FOR DIR-3 KYC FORM:-
- Signed copy of AADHAR CARD
- Signed copy of PAN CARD
- Personal and Working EMAIL ID (needed for verification through OTP)
- Personal and Working PHONE NUMBER (needed for verification through OTP)
- Valid DIGITAL SIGNATURE of the applicant.

- OTP Validation for Mobile Number & email id is compulsory
- This Form is Straight Through Process (STP) model, No RoC approvals
